Moss Adams LLP and its subsidiaries (collectively, “Moss Adams,” “we,” “us” and “our”) provide professional services, including assurance, tax, financial advisory, and consulting services to private and publicly-traded businesses, non-profit and governmental organizations, and individuals. This privacy policy describes how we collect, use, and disclose your personal information when we interact with you via this website and other sites we operate, and in connection with the services we provide. This privacy policy also describes your rights with respect to your personal information, and how to contact us regarding our privacy practices. If you are a client of Moss Adams, please refer to your contract with Moss Adams for additional information about the information we collect and use.

By submitting personal information to us, you agree to the use of such information, including any disclosures, processing, and transfers of your information to third parties by Moss Adams, in accordance with this privacy policy. Any consent you provide is entirely voluntary. If you do not accept this privacy policy, then you should not submit any personal information to Moss Adams through this website or other sites we operate, or in connection with any services.

Please be aware that this site contains links to other sites that are not governed by this privacy policy. We encourage visitors to review the privacy policy of each site before disclosing personal information.

1. Notice of Personal Information Collection and Use

Moss Adams collects personal information for various business purposes. You may provide us with personal information, such as your name and contact information, directly or via our service providers by submitting your resume or work history information, subscribing to publications, joining our mailing lists, participating in surveys, registering for events (e.g., webcasts or seminars), requesting access to specific content, submitting requests to meet with Moss Adams representatives, or by submitting requests through our “Contact Us” or “Submit RFP” mailboxes. In some instances, we or our service providers may automatically collect certain types of information using online identification technologies, such as cookies and beacons, when you visit our sites or through the emails we exchange. We may use the personal information you submit through the site to respond to your requests, send you information about our services or events, send you administrative information or notices, advertise our services to you on other sites or social media platforms, provide a more personalized experience, improve our site, and for our internal business purposes. If you no longer wish to receive promotional communications from us, you may request at any time that we discontinue sending you such materials by contacting us using the contact information listed below.

We do not seek “sensitive personal information” or “sensitive data” as defined under applicable privacy law on this website. If you choose to apply for a job through our careers site, we may collect information such as your name, address and other contact information, work and educational experience, licenses and certifications, and other personal information, which may include sensitive personal information. Your decision to submit such information is entirely voluntary. We may use this information to process and evaluate your application for employment and to communicate with you about employment opportunities. We may also retain and use this information to identify, and communicate with you about, future potential employment opportunities with us. If we elect to make an offer of employment, this information may become part of the employee file and may be used for other employment and work-related purposes.

In connection with providing services, we enter into contracts with our clients that describe the scope of services for which information is collected and used. We may obtain your personal information in the course of providing professional services to our clients. A client that provides us with third-party personal information is responsible for obtaining from such third parties the consents that may be required by law or regulation to allow such production. Individuals who engage Moss Adams may need to provide their personal information for us to perform the services requested.

Our legal basis for processing any personal information provided to us is either that (i) you have expressly consented to the practices described in this privacy policy by voluntarily providing your personal information to Moss Adams; (ii) such processing is necessary for the performance of a contract where Moss Adams has been engaged to provide services; (iii) to meet legal, regulatory or professional standards obligations; or (iv) to perform activities in furtherance of our lawful and legitimate interests. Examples of such lawful and legitimate interests for use of data in our possession or control include conducting internal administrative activities, marketing our services and analyzing our marketing efforts, and enhancing and personalizing a visitor’s experience on our sites.

We do not use profiling or make decisions based solely on the automated processing of your personal information. We retain personal information for only so long as necessary for the intended purpose for which it was collected, unless a longer retention period is required or permitted by law or our document retention policies based on professional standards and best practices. We may also store your name, email address, and other contact information such as company, title and industry in a customer relationship management tool and use it to manage our relationship with you and/or your company.

Moss Adams makes the following disclosures with respect to “consumers,” as defined under applicable privacy law, regarding categories of personal information, categories of sources of personal information, purpose of processing personal information, and categories of third parties to whom personal information may be disclosed:

1.1 Site Logging and IP Addresses

As is the case with many commercial sites, Moss Adams automatically logs certain information about visitor access to a site, which may include a visitor’s internet protocol (IP) address, browser type, device identifier, language, internet service provider, pages and content viewed, referring/exit pages, and/or operating system, as well as date and time stamps. A visitor’s IP address may be used for information technology (IT) security and systems diagnostic purposes. It may also be used in aggregate form to understand site usage trends and performance analysis.

1.2 Cookies

This site employs cookies and web beacons to track usage and provide a better online experience. Cookies are small data files stored on a visitor’s computer or internet-enabled device that serve a number of purposes such as enhancing your online experience when visiting our sites by remembering elections made, content accessed or downloaded, and responses to forms and surveys. The use of cookies is common practice for most sites; however, most web browsers include settings that allow visitors to decline cookies.

We show a cookie banner on some of our sites to inform visitors that we use cookies and similar tracking technologies to personalize content we display based on your preferences, provide social media features like sharing pages to your networks, analyze our sites’ performance, and advertise our services to you. We share information our trackers collect with advertising partners who help us with these use cases.

If you do not accept our cookies, you may not be able to fully experience some of our sites’ functionality. After you finish browsing our sites, it is possible for you to delete cookies from your system if you choose to do so.

Further information about managing cookies can be found in your browser’s help file or through sites such as www.allaboutcookies.org.

What types of cookies do we use?

There are two basic categories of cookies, first-party and third-party. They are both served to the visitor. First-party cookies are directly served by Moss Adams, while third-party cookies are served on behalf of Moss Adams by a service provider through Moss Adams’ sites and through email marketing. More specifically, we use cookies for the following purposes:

Necessary Cookies

These cookies are necessary for the website to function and cannot be switched off in our systems. They are usually only set in response to actions made by you which amount to a request for services, such as setting your privacy preferences, logging in or filling in forms. You can set your browser to block or alert you about these cookies, but some parts of the site will not work without the cookies enabled. These cookies do not store any personally identifiable information.

Performance Cookies

These cookies allow us to count visits and traffic sources so we can measure and improve the performance of our site. They help us to know which pages are the most and least popular and see how visitors move around the site. All information these cookies collect is aggregated and therefore anonymous. If you do not allow these cookies we will not know when you have visited our site and will not be able to monitor its performance.

Preferences Cookies

These cookies enable the website to provide enhanced functionality and personalization. They may be set by us or by third party providers whose services we have added to our pages. If you do not allow these cookies, then some or all of these services may not function properly.

Targeting Cookies

These cookies may be set through our site by our advertising partners. They may be used by those companies to build a profile of your interests and show you relevant advertisements on other sites. If you do not allow these cookies, you will experience less targeted advertising.

We may use Google Analytics, or similar services, for analytics. These analytics services may use cookies and other tracking technologies to help us analyze website visitors and how they use the website. Information sent by your browser, including your IP address, may be used as anonymous aggregated statistical data to analyze our web traffic, improve the quality of our website, and enhance your browsing experience. View Google’s privacy policy. You can opt out of Google’s advertising features through ad settings, ad settings for mobile, or any other available means. Access Google Analytics’ available opt-outs through Google's privacy policy.

BY ACCESSING OUR ONLINE SERVICES, YOU AGREE THAT WE, OR A SERVICE PROVIDER ACTING ON OUR BEHALF, CAN PLACE THESE COOKIES ON YOUR INTERNET-ENABLED DEVICE.

1.3 Email Communications

In some of our newsletters and other email communications, we may monitor recipient actions such as email open rates through embedded links within the messages. We and our marketing partners collect this information to gauge interest and to enhance future visitor experiences.

If you do not wish us to confirm whether you have opened, clicked on, or forwarded our email communications, you will need to unsubscribe, as it is not possible for us to send these emails without tracking enabled. Registered subscribers can update their communication preferences at any time by following the instructions in the individual email communications you receive from us.

1.4 Do Not Track Signals

Some web browsers incorporate a “do-not-track” or similar feature that signals to sites with which the browser communicates that a visitor does not want to have the visitor’s online activity tracked. As of the effective date of this privacy policy, not all browsers offer a “do-not-track” option, and “do-not-track” signals are not yet uniform. For this reason, the Moss Adams website may not respond to all “do-not-track” signals.”

1.5 Third-Party Sites and Social Sharing

We may use Web services from third parties on this site to present content within the pages of this site, e.g., to display videos and social content, to conduct surveys, etc. We cannot prevent these Web services from collecting information on your usage of this embedded content and recommend that you review their respective terms of use and privacy policies for further information.

We provide visitors the capability to share links to our content via social media and email. This capability connects visitors directly with their third party social media platforms and email providers. No personal information, logins or passwords are made available to or stored by Moss Adams in connection with this activity. After the content sharing is initiated, all interactions are directly between the visitors and their respective social media platforms or email providers. We recommend reviewing the respective terms of use and privacy policies of your social media platforms and email providers for further information.

2. Your Rights and Choices

Applicable laws and regulations provide certain individuals with specific rights regarding their personal information. This section summarizes your rights and explains how to exercise those rights.

2.1 Right to access and data portability

You have the right to request that we disclose certain information to you about our collection and use of your personal information. Once we receive and confirm your verifiable request, we will disclose to you:

  • The categories of personal information we collected about you
  • The categories of sources for the personal information we collected about you
  • Our business or commercial purpose for collecting that personal information
  • The categories of persons to whom we disclose that personal information
  • The specific pieces of personal information we collected about you (also called data portability)

2.2 Right to correct or delete

You have the right to request that we correct or delete your personal information that we collected from you and retained, subject to certain exceptions. After we receive and confirm your verifiable request, we will correct or delete (and direct our service providers to correct or delete) your personal information from our records, unless an exception applies.

We may deny your correction or deletion request if retaining the information is necessary for us or our service providers to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities
  3. Debug products to identify and repair errors that impair existing intended functionality
  4. Exercise free speech, ensure the ability of other individuals to exercise their free speech rights, or exercise another right provided for by law
  5. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent
  6. Enable solely internal uses that are reasonably aligned with expectations based on your relationship with us
  7. Comply with legal and regulatory obligations
  8. Make other internal and lawful uses of the information that are compatible with the context in which you provided it

2.3 Exercising your rights to access, correct, or delete

To exercise the access, data portability, correction, and deletion rights described above, please submit a verifiable request to us one of the following ways:

Only you, or someone legally authorized to act on your behalf, may make a verifiable request related to your personal information.

You may only make a verifiable request for access or data portability twice within a 12-month period. The verifiable request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative of such person
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable request does not require you to create an account with us. We will only use personal information provided in a verifiable request to verify the requestor's identity or authority to make the request.

2.4 Response timing and format and appeal

We endeavor to respond to a verifiable request within 45 days of receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

You may appeal our decision with regard to your request by contacting us 1-844-962-1482, or submitting an appeal here.

2.5 Sales of personal data

Moss Adams does not “share” or “sell” personal information as defined under applicable law. However, some transfers of personal information are considered “sales” under applicable law even if monetary consideration is not involved. This may include the use of cookies. You can read more about our cookies use in this privacy policy. You can view a list of those cookies and opt out of use of non-essential cookies via this form Tracking Preferences.

2.6 Non-discrimination

We will not discriminate against you for exercising any of your rights. Unless permitted by law, we will not engage in any of the following activities in response to your exercise of rights described in this section:

  • Deny you goods or services
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties
  • Provide you a different level or quality of goods or services
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services

3. Disclosures and Transfers

Moss Adams does not disclose personal information except as set forth in this privacy policy, when you have given permission to make the disclosure, or as necessary for the purpose for which the information was submitted. We may disclose personal information in accordance with applicable law, or in compliance with legal or regulatory process or professional standards.

We may disclose personal information to our affiliated companies, professional advisors, insurers, benefit providers, legal or regulatory authorities, state or national boards of accountancy, and contractors and various third party service providers who are engaged to provide support of our internal operations or assistance with the services we provide. For example, we engage service providers to assist with IT administrative support services, such as identity management, security, hosting, back-up, and data analysis, and for support services related to storage and secure disposal of hard copy files. Such entities may be located within or outside the United States. We require all service providers to protect the information we entrust to them and to use such information only for specified business purposes.

4. Data Security

The security of your personal information is very important to us. We use reasonable and appropriate safeguards to protect your information, which include physical (e.g., secure office entry), technical (e.g., password protection, network firewalls, laptop encryption, authentication mechanisms), and administrative (e.g., confidentiality agreements, training, procedures that limit access to and use of data) measures. However, no method of transferring data over the internet or storing electronic data is entirely secure, so while we strive to use reasonable means to protect your personal information, we cannot guarantee security against all threats.

5. International Users

If you are visiting the website from outside the United States, please be aware that Moss Adams is based in the United States, and the information we obtain through the website will be transferred to, processed in, and stored on our servers in the United States and other countries where our service providers operate. The data protection laws and regulations applicable to your personal information transferred to the United States and such other countries may be different from the laws in your country.

6. COPPA

We understand the importance of protecting children’s online privacy. Our sites are not directed to children under the age of 13, and Moss Adams will never knowingly collect or maintain personal information through our sites from anyone under the age of 13. If we learn that we have received information directly from a child who is under the age of 13, we will delete such information as soon as possible.

7. Privacy Policy Changes

We may revise our privacy policy from time to time. We will post any changes on this site and will revise the “last updated” date at the top of this privacy policy. By continuing to use any of our sites, you agree that the terms of the privacy policy as of the effective date will apply to the information collected.
